First of all, so sorry to see you suffering with M.S. my heart goes out to you.

Unfortunately under Chapter 7 you are out of luck walking away from a student loan, so you may have to go as far as Chapter 13 which is painful and unless you have a spouse with a good solid credit rating, you will be in for 7 years of not being able to borrower money or have a credit card.

Have you tried negotiating with the student loan provider directly - tell them your situation. I hope you have tried talking to them.

Hi, I have M.S and a student loan of $129000. Unfortunately my illness and physical challenges limit me and I cannot work and make money to pay back my student loans. I want to file for chapter 7 bankruptcy and based on what I read student loans are not discharged under chapter 7. Does any one know of any exemption to this rule so that I can discharge my student loans. Thank you-Inga

Yes, thanks for this - bankruptcy is very stressful and it's good to read some encouraging words from someone who has been there - great to have good info to.

Thanks for this. I really need to read the part about not being alone in bankruptcy. It's been hell for my wife and I and our family.

Actually, these Bankruptcy schemes are VERY similar to other States in the U.S.

Chapter 7 and Chapter 13 bankruptcy are common through all States.
