California’s bankruptcy law provides the following 2 Schemes for claiming Chapter 7. Both of these personal bankruptcy schemes are listed below.
If you think that you are ready for bankruptcy, or considering personal bankruptcy, don’t despair. I’ve claimed chapter 7 once and it’s not the end of the world for you and your family.
You will regain your credit rating and your personal finances will rebound once you learn to handle your money in a more frugal and disciplined way. Take it from someone who has dealt with personal bankruptcy (and helped other people who have claimed chapter 7) you will adjust to this time in your life. This is just temporary and YOU ARE NOT A BAD PERSON – you are just learning as you go like everyone else on the planet.
If you are suffering from stress due to your impending bankruptcy, try to always remember that you are not alone. Repeat! You are not alone, and with the ever-increasing flood of individuals facing bankruptcy and foreclosure these days you are DEFINITELY not alone.

Good data to have for California based bankruptcy laws and guidelines – how up to date are the numbers in these Chapter 7 schemes?

Actually, these Bankruptcy schemes are VERY similar to other States in the U.S.
Chapter 7 and Chapter 13 bankruptcy are common through all States.

Thanks for this. I really need to read the part about not being alone in bankruptcy. It’s been hell for my wife and I and our family.

Yes, thanks for this – bankruptcy is very stressful and it’s good to read some encouraging words from someone who has been there – great to have good info to.

Hi, I have M.S and a student loan of $129000. Unfortunately my illness and physical challenges limit me and I cannot work and make money to pay back my student loans. I want to file for chapter 7 bankruptcy and based on what I read student loans are not discharged under chapter 7. Does any one know of any exemption to this rule so that I can discharge my student loans. Thank you-Inga

First of all, so sorry to see you suffering with M.S. my heart goes out to you.
Unfortunately under Chapter 7 you are out of luck walking away from a student loan, so you may have to go as far as Chapter 13 which is painful and unless you have a spouse with a good solid credit rating, you will be in for 7 years of not being able to borrower money or have a credit card.
Have you tried negotiating with the student loan provider directly – tell them your situation. I hope you have tried talking to them.
